Text of Reaffirmation 23-07.004:
WHEREAS, the United States Supreme Court issued regressive rulings rolling back fundamental constitutional rights by e.g., overturning longstanding abortion and reproductive rights in Roe v. Wade, ending race-based affirmative action, limiting protections for LGBTQIA+ people, undermining voting rights, gutting environmental regulations to combat climate change, ruling against common-sense gun laws, blocking student debt relief, and elevating religious beliefs and rights above other fundamental rights; and
WHEREAS, recent revelations that U.S. Supreme Court justices including but not limited to Justices Clarence Thomas and Samuel Alito, accepted undisclosed lavish gifts and other forms of remuneration involving individuals with cases before the court, raising significant questions about the lack of oversight and impartiality of the U.S. Supreme Court justices as compared to other judges and officials that are subject to oversight and ethical codes of conduct, as well as creating numerous conflicts of interest on the U.S. Supreme Court, and eroding public confidence in the nation’s highest court; and
WHEREAS, United States Supreme Court justices are appointed for life and the current court has a supermajority of relatively young extremist right-wing justices that oppose personal freedoms supported by a majority of Americans, and blatantly disregard established judicial norms, historical precedents, and mainstream jurisprudence;
THEREFORE BE IT RESOLVED, that the California Democratic Party supports transparency, responsiveness, respect for civil rights, and personal freedoms, and holding the United States Supreme Court accountable through legal means such as investigations into conflicts of interest, imposition of a judicial code of ethical conduct, and expanding the number of justices on the U.S. Supreme Court to thirteen to reflect one Supreme Court justice for each of the federal appellate districts.

Text of Resolution 26-JHD-25:
WHEREAS, the Constitution does not specify the number of justices, leaving it to Congress, which last set the number at nine in 1869;
WHEREAS, increasing the Supreme Court bench to 13 seats matches the number of federal circuit courts;
WHEREAS, the population of the United States has increased significantly since 1869; and,
WHEREAS, adding four seats is the only way to restore balance to the Court;
THEREFORE, RESOLVED, the DPW supports legislation adding four seats to the Supreme Court, requiring a binding judicial ethics standard, and adding term limits.
